Terms of Service

These terms explain how you may use WhatsTheDx and what to expect from our educational clinical reasoning service.

1. Acceptance of these terms

WhatsTheDx is operated by PreTectal LLC. By accessing or using WhatsTheDx, you agree to these Terms of Service. If you do not agree, you may not use the service.

If you use WhatsTheDx on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. What WhatsTheDx provides

WhatsTheDx is an educational clinical reasoning game for healthcare students and professionals. The service may include daily cases, clues, diagnosis guesses, case archives, explanations, specialty tracks, progress history, and Pro subscription features.

We may add, remove, test, or change features over time. We try to keep the service useful and available, but we do not guarantee that every feature or case will always be available.

3. Accounts and eligibility

  • You must be at least 18 years old to create an account.
  • You are responsible for providing accurate account information.
  • You are responsible for protecting your login credentials and account activity.
  • You must notify us if you believe your account has been compromised.
  • We may suspend or terminate accounts that violate these terms or create risk for the service.

4. Pro subscriptions, billing, and cancellation

WhatsTheDx Pro is a single account-wide plan: one subscription unlocks the full case archive, early access to unpublished cases, and performance analytics across every specialty. Pro is available as an auto-renewing monthly subscription or as a one-time lifetime purchase.

  • Monthly subscriptions renew automatically until canceled.
  • Lifetime access is a one-time purchase that unlocks Pro across every specialty and does not create recurring charges.
  • Payments are processed by Stripe. We do not store full payment card numbers.
  • You can cancel or manage a monthly subscription anytime from the Stripe billing portal, reachable from the Pro page.
  • After cancellation, paid access continues until the end of the current billing period.
  • Refunds are not provided for partial billing periods unless required by applicable law.
  • We may change prices or plan features with reasonable notice where required.

5. Acceptable use

You agree not to misuse WhatsTheDx. Prohibited conduct includes:

  • Sharing, selling, or transferring account credentials.
  • Scraping, crawling, bulk downloading, or reproducing service content without permission.
  • Attempting to bypass access controls, payment checks, rate limits, or security features.
  • Uploading or entering real patient identifiers, protected health information, or confidential clinical data.
  • Using the service for unlawful, harmful, deceptive, or abusive activity.
  • Interfering with the operation, security, or integrity of the service.

6. Discussion rules

Discussion posts are for educational exchange about completed cases. When you post, you agree to all of the following:

  • Keep posts professional, respectful, and focused on clinical reasoning and the case at hand.
  • Do not post real patient identifiers, protected health information, patient images, or confidential clinical, workplace, or academic information.
  • Do not request, give, or present content as medical advice for a real patient. Do not use discussion posts to make or direct patient-care decisions.
  • Do not post harassment, hate speech, threats, sexual content, personal attacks, doxxing, or impersonation.
  • Do not knowingly post false, misleading, or dangerous clinical claims.
  • Do not post spam, advertising, referral promotions, solicitations, or repetitive external links.
  • Posts are not confidential. Do not share private information that you would not want other users to see.
  • You may report content that appears to violate these rules. Reports do not guarantee removal, and we may review, remove, restrict, or preserve content and suspend or terminate accounts when we reasonably believe it is necessary to protect users or the service, enforce these terms, or meet legal obligations.

7. Content ownership and limited license

The cases, clues, diagnoses, explanations, interface, branding, and other service content are owned by PreTectal LLC or its licensors and contributors. They are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, personal, non-transferable license to use the service for educational and practice purposes. These terms do not grant permission to copy, redistribute, publish, sell, or create competing datasets from our content.

You retain ownership of discussion posts you create. By posting, you grant PreTectal LLC a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and use the post as needed to operate, secure, and improve the discussion service. This license ends when your post is deleted, except where continued retention is required for backups, legal obligations, dispute resolution, or abuse prevention.

8. Educational use only - not medical advice

WhatsTheDx is for education, practice, and entertainment. It is not medical advice, clinical guidance, diagnosis, treatment recommendation, or a substitute for professional judgment.

Do not use WhatsTheDx to make real patient care decisions. Clinical decisions should rely on licensed professional judgment, applicable guidelines, institutional policies, supervisors, and the facts of the real patient encounter.

9. Service availability and third-party services

WhatsTheDx relies on third-party providers for hosting, authentication, database services, payments, email, and related infrastructure. Interruptions or changes from those providers may affect the service.

We may suspend access for maintenance, security, legal, operational, or abuse-prevention reasons. We are not responsible for data loss or service disruption outside our reasonable control.

10. Disclaimers and limitation of liability

The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

To the fullest extent permitted by law, PreTectal LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, service interruption, or reliance on educational content.

11. Changes to these terms

We may update these terms from time to time. When we do, we will update the date on this page. If a change is material, we will provide notice through the service or another reasonable method when required.

Continued use of WhatsTheDx after updated terms take effect means you accept the updated terms.

12. Governing law and contact

These terms are governed by the laws of the State of California, without regard to conflict of law rules, unless applicable law requires otherwise.
